By creating an account, starting a conversation with Tera, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company, you represent that you are authorised to bind that company to these Terms.
These Terms work together with our Privacy Policy, which explains how we handle personal data and is incorporated here by reference.
1. The Service
Teracrowd provides an AI-powered conversation and people-intelligence platform. Tera conducts a short voice or text conversation (about 15 minutes) and generates a structured profile and, in the recruitment product, a recommendation and scores that help an employer understand a person beyond their résumé.
A human makes the decision. Tera produces information and a recommendation only. Any hiring, interview, or selection decision is made by a person at the employer, not by Tera. You are responsible for how you use Tera's output, including compliance with employment, anti-discrimination, and equal-opportunity laws that apply to you.
We may add, change, or remove features of the Service over time.
2. Eligibility
You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate.
3. Accounts
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree to provide accurate account information and to keep it up to date.
- Notify us promptly at [email protected] if you suspect unauthorised use of your account.
- We may suspend or terminate accounts that violate these Terms or that create risk for the Service or other users.
4. Acceptable use
You agree not to:
- use the Service to break the law or to infringe anyone's rights;
- record or submit a person's voice or personal data without the consent and notice required by law;
- use Tera's output as the sole basis for a decision that produces a legal or similarly significant effect on a person, in a way that removes meaningful human review;
- attempt to reverse-engineer, scrape, overload, disrupt, or gain unauthorised access to the Service or its underlying systems;
- upload malicious code, or use the Service to harass, deceive, or harm others;
- resell or provide the Service to third parties except as expressly permitted in writing.
We may investigate and take appropriate action, including suspension or termination, for any suspected violation.
5. Candidate data and consent
Where you (an employer or account user) invite candidates to a conversation with Tera, you are responsible for having the lawful basis and providing any notice required to invite them and to process the outcome. Teracrowd operates on the principle that the candidate owns their profile, and a candidate's profile is shared with an employer only with the candidate's explicit, per-employer consent, as described in the Privacy Policy.
6. Fees and payment
- Paid plans are billed through our payment processor, Stripe. By providing payment details, you authorise us (via Stripe) to charge the applicable fees.
- Fees, billing frequency, and plan details are those presented to you at sign-up or in a separate order or agreement.
- Unless stated otherwise or required by law, fees are non-refundable.
- We may change fees on a going-forward basis with reasonable notice; changes do not apply to a period you have already paid for.
- You are responsible for any taxes other than taxes on our income.
7. Intellectual property
- The Service, including its software, design, and content (excluding your data), is owned by Teracrowd and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
- Your data stays yours. You retain ownership of the content and personal data you submit. You grant us a limited licence to process it solely to provide and improve the Service as described in the Privacy Policy.
- You may not use our name, logo, or brand without our prior written permission.
8. Third-party services
The Service relies on third-party providers (for example, OpenAI, ElevenLabs, Stripe, and others listed in our Privacy Policy). Your use of the Service may be subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.
9. Disclaimers
The Service is provided "as is" and "as available." Tera's profiles, scores, and recommendations are probabilistic assessments, not guarantees, and may contain errors. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result will meet your expectations or legal requirements.
You remain solely responsible for your hiring and employment decisions and for complying with the laws that apply to them.
10. Limitation of liability
To the maximum extent permitted by law, Teracrowd and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Indemnification
You agree to indemnify and hold Teracrowd harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right — including your obligations regarding candidate notice, consent, and non-discrimination.
12. Termination
- You may stop using the Service and close your account at any time.
- We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service.
- On termination, your right to use the Service ends. Sections that by their nature should survive (for example, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive. Data handling after termination is governed by the Privacy Policy.
13. Changes to these Terms
We may update these Terms. If we make a material change, we will notify you (by email or in-app) and update the "Last updated" date. Your continued use of the Service after a change takes effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have jurisdiction over any dispute, unless mandatory law in your country of residence provides otherwise.
